Charlie Sheen Granted Sole Custody If Ex-Wife Fails Drug Test, Court Order Reveals
Los Angeles, [Date] – In a recent development, actor Charlie Sheen has been granted sole custody of his 14-year-old twin sons, born to his ex-wife Brooke Mueller, contingent upon her failing a drug test, according to an order from the Los Angeles County Superior Court.
The terms of the agreement were reached out of court in both November 2022 and August 2023. On Thursday, Sheen sought a court ruling through an ex parte motion, expressing confidence that Mueller would not oppose the request for temporary emergency orders.
The nature of the ex parte motion remains unclear, and it was filed and granted on the same day without Mueller’s response. A representative for Mueller refrained from commenting on the matter, while Sheen’s lawyer stated that his client had no comment at this time.
Currently, the former couple shares joint legal custody of their sons, with the primary residence being with Sheen, as outlined in the documents. However, Mueller faces an immediate loss of custody and visitation rights if she tests positive for drugs or alcohol.
Documents filed in November 2022 specify that Sheen would gain sole custody of the twins, Max and Bob, in the event of Mueller testing positive for substances or relapsing, until further court orders or a written agreement between the parties.
The documents also outline the frequency of drug and alcohol testing for Mueller, stipulating that she must comply within 24 hours of a written request from Sheen or his attorney, and at a minimum of once per week.
Reports suggest that Mueller allegedly experienced a relapse during the previous summer, according to the August document related to their previously agreed-upon child custody orders.
The history between Sheen and Mueller dates back to their finalized divorce in 2011, with both actors struggling with addiction. Sheen has a legal record of arrests in domestic violence cases and has undergone rehabilitation. In 2011, a Los Angeles judge removed their twins from Sheen’s home following allegations of violence raised by Mueller.
Meanwhile, Mueller faced legal troubles in 2012, receiving a year of probation for an incident at a nightclub in Aspen, Colorado, where she allegedly assaulted a woman. She pleaded guilty to a drug possession charge, avoiding jail time through participation in an intensive inpatient rehab program.
